MOLDY SHOES, located at Provincia de Panamá, Distrito de Panamá, Corregimiento de Betania, Urbanización Miraflores, Calle 79 B Oeste, Edificio PH Miraflores I Planta Baja, Apartment 2, is responsible for collecting your personal data, the use given to such data, and its protection.
In accordance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties (hereinafter referred to as the “Law”) and its Regulations, we kindly ask you to carefully read the Terms and Conditions contained in this Privacy Notice (the “Notice”), as this Notice contains the applicable terms and conditions regarding the Personal Data collected by MOLDY SHOES, in case you grant your consent. Your personal information will be used to provide the services and products you have requested, inform you of any changes to them, and evaluate the quality of the service we provide.
As part of its normal activities and in accordance with its lawful corporate purpose, MOLDY SHOES, in some cases, collects and stores information considered as Personal Data, under the terms of the Law, and is therefore subject to its regulations. The Personal Data that you provide to the Data Controller, or that is generated through visits to the MOLDY SHOES site, will vary in each specific case depending on your activities on the site, and may include the following:
A. When submitting comments through the contact form: by using this functionality, only the following Personal Data will be collected and stored: a) General Data: Full name (as provided by you), your email address, and any other information you enter in the comments. In all cases, the accuracy and truthfulness of the Personal Data collected is your responsibility, since you are the one with access to your social media profiles and the one who provides your nickname.
B. In all cases, when accessing the MOLDY SHOES website, data will be collected through Cookies and Web Beacons. These elements collect the IP address, browser type and operating system, websites you visit, browsing and consumption habits and patterns, the links you follow, and the website visited before entering ours. From all the aforementioned Personal Data, a user profile is created, which is used for the purposes described below.
Sensitive Personal Data. MOLDY SHOES does not collect Sensitive Personal Data. Your Personal Data will be used and processed for the purposes specifically described below:
A. Primary purposes. a) If you fill out the contact form, to contact you, answer your questions, and propose a possible commercial relationship, based on your needs or those of the company you represent.
B. Secondary purposes. a) To identify, locate, communicate with, or contact you, to send information, and for statistical and scientific use (metrics analysis); b) To develop, either directly or through affiliates or third parties, studies about the interests, behaviors, and demographics of Data Subjects, in order to better understand their needs and interests and offer improved news services; c) To improve our commercial initiatives and strategies; d) To analyze visited websites and searches performed by Data Subjects, to improve our content and articles, including their customization, presentation, scheduling, and services; e) To send information via email regarding relevant news or events.
MOLDY SHOES will not transfer your Personal Data without your consent, although it may use it for purposes involving third parties, such as statistics and newsletter distribution, without this constituting a transfer of such Data. If you do not consent to your personal data being transferred under the terms stated in this Privacy Notice, you may request it through your support account.
The duration of Personal Data handling will be indefinite from the date you provided it to the Data Controller, and you may object at any time you deem appropriate, for the blocking and cancellation of such data. Once you provide your Personal Data to the Data Controller by any means, we inform you that it will be stored in a CRM system of the site itself, with access limited only to the Data Controller. Your personal data will always be treated lawfully and in compliance with the principles of Legality, Consent, Information, Quality, Purpose, Loyalty, Proportionality, and Responsibility, in accordance with the provisions of the Law.

You will always have access to your Personal Data and/or Sensitive Data, either to request rectification, cancellation, opposition, or revoke your consent, in accordance with the Law (the “ARCO Rights”), in written or electronic form, through the procedure available here. Your request must be addressed to MOLDY SHOES or sent to [info@moldyshoes.com]. Such request must be accompanied by: a. A photograph or scan of your official identification with photo and autograph signature or, if acting on behalf of someone else, also include a copy of the notarized and/or publicly registered power of attorney and, if applicable, the articles of incorporation. b. A scan or photograph of a proof of address. In the written request, you must: i) State your name or company name and provide a physical address for correspondence, communications, documentation, and responses; ii) Indicate the Personal Data to which you wish to access, or that you want to be rectified, canceled, reviewed, as well as to oppose processing or revoke consent; iii) State if you know or remember the purpose for which you provided the data and the name of the Data Controller to whom you provided it; and iv) Clearly, respectfully, and concisely set forth your request, as well as provide any other information or document that may help locate your Personal Data. The Data Controller will have twenty days from receipt of the request to resolve it or request additional information. If your request is deemed valid, because you proved your identity and your Personal Data was found in our database, within no more than fifteen days, it will be carried out. The Data Controller will keep you informed of the process whenever you request it. The response and access to your Data, as well as supporting documents, may be delivered, upon proof of identity and/or representation, through certified copies by the company and its legal representative, electronic documents, or simple copies. Whenever the request is made electronically, preference will be given to such means for sending responses and resolutions. In the event that the Data Controller needs to use your Personal Data for purposes other than those stated in this Privacy Notice, you will be contacted in writing, by phone, electronically, or by any optical, sound, visual, or other means that technology allows now or in the future, and the new uses of such information will be explained in order to obtain your consent.
